These Terms of Service govern access to and use of ToneNest, the AI phone receptionist, its dashboard, and related services provided by P&C Solutions. By subscribing to or using the Service, you agree to these Terms and to our Privacy Policy. If you are agreeing on behalf of a business, you represent that you have authority to bind that business.
The Service answers phone calls on your behalf using an AI phone agent, extracts structured information from those calls, and presents them to you in a dashboard for review and follow-up. Depending on your plan, it can also transfer calls to members of your team.
If your plan includes live transfers, you choose which calls are transferred and to which phone numbers. You are responsible for those numbers being correct and for having the consent of the people who answer them. Transferred calls show your business number. We do not guarantee that a transferred call will be answered; depending on your plan and settings, an unanswered transfer may reach the other phone’s voicemail or return to your agent.
You agree to use the Service only for lawful purposes, and to comply with all applicable laws regarding call recording, disclosure to callers, and handling of personal information collected through your use of the Service. Including obtaining any consents required in your jurisdiction for recording and AI-processing of calls.
The Service uses artificial intelligence to transcribe calls and extract structured information (such as names, callback numbers, or other details) from them. AI-generated transcripts, summaries, and extracted fields may contain errors, omissions, or misinterpretations, and are provided "as is" without warranty of accuracy or completeness. You are responsible for independently verifying any information from the Service before relying on it for decisions that matter to your business or your callers.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, regarding the Service, including any warranty of accuracy, merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, our total liability arising out of or related to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim, and we will not be liable for indirect, incidental, special, consequential, or punitive damages.
As between you and us, you retain ownership of the call data associated with your account. We process and store it as described in our Privacy Policy, including our data retention and deletion-request process.
Either party may terminate this agreement by canceling the subscription as described in Section 2. We may also suspend or terminate access for non-payment, violation of these Terms, or unlawful use of the Service.
We may update these Terms from time to time; material changes will be reflected by updating the "last updated" date above. We may also modify or discontinue features of the Service, though we'll aim to give reasonable notice of changes that materially reduce functionality you're actively paying for.
These Terms are governed by the laws of New York, without regard to conflict of law principles.
